The other Clinton told Kerry that he needed to say he would outlaw gay
marriage if he wanted to win in 2004. (Kerry refused.) This is just
more of the same thinking. The Clinton strategy often involves
behaving like a Republican. They want to take away the steam from the
"moral values" crew on the Republican side.

The "moral values" crew basically consists of the poorest, most
ignorant people in the country; the whole point of the Republican
strategy is that those people can never be satisfied because they
basically are wishing for a huge nationwide conversion to a particular
strain of fundamentalist Christianity. So the Republicans' political
moves are consistently against the better political interests of these
backward fools, but because the Republican politicians are constantly
decrying the corruption of our times and fighting the unwinnable
"moral values" fight, they still end up with the votes from the
anti-abortion/prayer in schools contingent. It's actually a very
fucked-up political party; it consists of the richest exploiters and
the most harshly exploited, working together, always against the
better interests of the poor. Somehow it holds together.

(Read Tom Frank "What's The Matter With Kansas?")

The proposed law is totally unfair to business; instead of a voluntary
system like movies have, any business where a kid scams a copy of a
game they're not supposed to have can be fined extremely large amounts
of money. That also is bad for civil liberties, obviously. Voting on
this law means that every Republican in the Senate is put in the
position of choosing a vote which is totally hostile to business --
and which favors big government at the expense of individual freedom
-- or going against the "moral values" crew in a big way. In other
words, it intentionally divides the Republican voter base.

The next Senate elections, every Republican who voted in favor of this
law will be painted as an enemy to business. Every Republican who
voted against it will be painted as an enemy of the "moral values"
crew. It's an absolutely brilliant strategy; too bad it's totally
evil. I'm hoping they think it won't pass anyway, and it's just a
fight move, but you never know with the Clintons.
